Section 179(2) of the UK's Online Safety Act states that the offense of sending a false message intended to cause harm (created in s.179) cannot be committed by the holder of a licence under the Broadcasting Act 1990 or 1996 if the action was done under the authority of that license. Similarly, subsection (2) of section 179 exempts broadcasters and other media outlets from the false communications offense when they are acting within the scope of their licensed activities. Section 179(2) specifies that a person cannot be prosecuted for the offense defined in section 179 if they are a broadcaster with a license and the communication was made in connection with their licensed duties. Section 179 itself creates an offense for sending a message that the sender knows is false and intends to cause non-trivial psychological or physical harm, with no reasonable excuse for doing so. This exemption in 179(2) is one of several in the Act that protects certain types of media and content creators from liability for communications offenses under the Act when they are operating within the bounds of their existing licenses.
